The Supreme Court is grappling with President Donald Trump's birthright citizenship order that could have significant consequences for determining who is and who isn't an American.

Under the U.S. Constitution, the 14th Amendment grants automatic citizenship to "all persons born or naturalized" in the country or its jurisdictions. But as part of the administration's aggressive strategy to restrict immigration, the president issued an executive order last year saying that doesn't apply to the children of people who are in the country illegally or temporarily.

Much of the case hangs on how the current court views a landmark 1898 ruling  upholding the citizenship of a San Francisco-born man whose Chinese parents were barred from becoming citizens under the laws of the time.

During the April 1 oral arguments , which Trump attended in person, some of the conservative-leaning justices seemed skeptical about administration's legal presentation.

"The examples you give to support (your position) strike me as very quirky," Chief Justice John Roberts told the Justice Department attorney arguing Trump's side of the case.

Congressional Black Caucus scholarships face legal scrutiny

The Congressional Black Caucus is being called out by an anti-affirmative action group, which is suing over college scholarships for Black students from underfunded schools.

At issue is eligibility for the foundation's CBC Spouses Education Scholarship, which is limited to Black students in congressional districts represented by 62-member caucus.

The scholarships, according to the CBC foundation, help Black students navigate "inequitable education systems" amid shrinking federal investments in education, according to a February blog post .

But the American Alliance for Equal Rights said in the lawsuit, filed on behalf of two students who are Hispanic and Asian, those awards illegally discriminate based on race. It's part of a larger legal strategy stemming from a  broader effort to upend diversity programs since Trump returned to office.
